The city's argument is nonsense, of course, but if you have a copyright you have to send nonsensical letters to show you're diligent about protecting it. What's involved is clearly a parody of the symbol, not a theft of it, and if the city takes any action against the Occupiers over this we First Amendment zealots will flock to their defense. Now that they've made the obligatory objection, surely the city's lawyers will find more worthwhile problems to, er, occupy their time.
